1. GENERAL CONDITIONS OF CONTRACT

INFORMATION PRIOR TO THE CONTRACT PROCESS

This website www.centrovital.es is owned by CENTRO VITAL with NIE Y4541895F and fiscal address at CALLE SANT PERE MÁRTIR 8, PRIMER, 08012 BARCELONA – (BARCELONA).

The General Contracting Conditions regulate the distance selling relationship between CENTRO VITAL and the user or client, in accordance with the legal stipulations, especially Law 7/1998, of April 13, on General Contracting Conditions, the Law 3/2014, of March 27, which modifies the revised text of the General Law for the Defense of consumers and Users, Organic Law 15/1999, of December 13, of Protection of Personal Data, the Law 7/1996, of January 15, on the Regulation of Retail Trade, and Law 34/2002 of July 11, on Services of the Information Society and Electronic Commerce.

CENTRO VITAL reserves the right to make the modifications it deems appropriate, without prior notice, in the General Conditions. Said modifications may be made, through their websites, by any form admissible by law and shall be binding during the time they are published on the web and until they are validly modified by subsequent ones. However, CENTRO VITAL reserves the right to apply, in certain cases, Specific Contracting Conditions in preference to these General Conditions when it deems it appropriate, announcing them in a timely manner.

The duration of the contract will be linked to the delivery of the product without prejudice to the right of withdrawal.

Likewise, you can subscribe to the newsletter to receive offers of the aforementioned products or general information that may be of interest to you.

As a user or client, you expressly declare to know, understand and accept the conditions of use and these general contracting conditions. In the same way, you declare to be of legal age and have the legal capacity and to act necessary for accessing the CENTRO VITAL websites and contracting through them.

It is an essential requirement that you register as a user of the web to make the online purchase. You can access the corresponding section for registration on the website itself. In accordance with the provisions of Organic Law 15/1999 on the Protection of Personal Data, CENTRO VITAL informs users that the personal data collected during the registration process and subsequent purchase will be entered in a file under their responsibility, with the purpose of processing said actions by the user and managing subsequent actions derived from them. The customer, upon receiving the product at the delivery address provided, will receive an invoice or copy of the order.

OFFER AND VALIDITY

In the case of a product on sale, it will always be indicated along with its essential characteristics, the offer price and the validity of the same.

In compliance with current regulations, CENTRO VITAL offers information on all items for sale, their characteristics and prices. However, CENTRO VITAL reserves the right to withdraw, replace or change the products offered through its website, by simply changing its content. In this way, the products offered at any time on the web will be governed by the General Contracting Conditions in force in each case. Likewise, the company will have the power to stop offering, without prior notice and at any time, access to the aforementioned products.

ESSENTIAL CHARACTERISTICS OF THE PRODUCTS

The products offered in our online store incorporate photographs and the essential characteristics of the same, this is the information obtained from the manufacturer itself.

GUARANTEE

All the products offered on the website enjoy the commercial guarantee of its supplier. CENTRO VITAL has an after-sales service, while the guarantee is in force, the client can execute it by going to the CENTRO VITAL establishment, the after-sales service, by email to info@centrovital.es or to the points established by the provider itself. PRICES

All products indicate the sale price in Euros and include Value Added Tax (VAT).

If any other tax is applicable, this will be indicated (IGIC or IPSI).

PAYMENTS AND EXECUTION OF THE ORDER

The customer may pay the amount of his order by opting for any of the following ways. During the purchase process you must indicate your choice:

• VISA OR MASTERCARD CREDIT CARD

All operations that involve the transmission of personal or banking data are carried out using a secure environment, a server based on the standard security technology SSL (Secure Sockets Layer). All the information that you transmit to us travels encrypted through the network.

Likewise, the information about your credit card is entered directly on the bank’s page, at the POS (Bank’s Point of Sale Terminal) and is not entered or registered in any CENTRO VITAL server.

When paying with a VISA or MASTERCARD card, the following information will always be requested: the card number, the expiration date, and a Validation Code that matches the last three digits of the number printed in italics on the back of your VISA or MASTERCARD card. , thus offering more guarantees about the security of the transaction.

This form of payment is valid only on the web.

If the amount of a purchase had been charged fraudulently or improperly using the number of a payment card, its holder may demand the immediate cancellation of the charge. In this case, the corresponding debit and reimbursement annotations in the accounts of the supplier and the holder will be made as soon as possible.

However, if the purchase had actually been made by the cardholder and the demand for return was not a consequence of having exercised the right of withdrawal or resolution and, therefore, had improperly demanded the cancellation of the corresponding charge, it will remain liable to CENTRO VITAL to compensate for the damages caused as a result of said cancellation.

• WIRE TRANSFER

When selecting the bank transfer, you will receive, together with the confirmation of your order, an e-mail with the bank details of CENTRO VITAL.

It is very important that when making the transfer you indicate in the subject the order number, as well as your name and surname, and make the transfer within 3 days after the order confirmation date in order to validate it.

If you wish, you can send us the proof of the transfer by e-mail to info@centrovital.es. But in any case, the order will not be considered effective until our administration department has bank confirmation of the transfer.

Remind you that the payment must be made in EUROS and that all eventual exchange and bank fees are your responsibility.

In the case of bank transfers made from outside Spain, it is very important that when ordering the transfer, you always inform your bank to take charge of the commissions at origin, those bank commissions and expenses corresponding to your entity. Otherwise, CENTRO VITAL could paralyze the shipment of your order by not receiving the full amount of it.

Possible exchange and banking commissions are borne by the client.

• PAYPAL

Allows you to send payments on the Internet safely and comfortably. PayPal’s network is built on the financial infrastructure existing bank accounts and credit cards to create a global real-time payment solution. PayPal offers a service specially designed for those who are not satisfied with traditional payment mechanisms.

CENTRO VITAL undertakes to deliver the order in a maximum of 24 hours (working days). * On Saturdays, Sundays and holidays there are no deliveries.

The availability of the products offered by CENTRO VITAL may vary depending on customer demand. Despite the fact that CENTRO VITAL updates the stock periodically, the product requested by the client could be out of stock at that time. In the event of non-execution due to unavailability, CENTRO VITAL will notify the client by means of an email as soon as it becomes aware of this situation. The period of this communication will not exceed in any case the maximum period of 30 days. CENTRO VITAL may give the double option of: supplying the customer without price increase, a product with similar characteristics or of higher quality, or except for justified and demonstrable reasons by CENTRO VITAL within this same period, pay the sums paid for the canceled order. In the event that CENTRO VITAL does not make this payment within the indicated period, the buyer may claim that double the amount owed be paid, without prejudice to their right to be compensated.

RIGHT OF WITHDRAWAL, RETURNS AND CLAIMS

The buyer will have a minimum period of fourteen calendar days to withdraw, from the day the customer receives the product, without any penalty and without indicating the reasons.

The exercise of the right of withdrawal must be carried out by notification through telephone communication to 645018136, addressing the email info@centrovital.es, sending your letter to our postal address CALLE SANT PERE MÁRTIR 8, PRIMER, 08012 BARCELONA – (BARCELONA).

As established in article 103 of Law 3/2014, of March 27, which modifies the revised text of the General Law for the Defense of consumers and Users, the supplies of services or goods made in accordance with the specifications of the consumer or clearly personalized, or that, by their nature, cannot be returned or may deteriorate or expire quickly, are exempt from withdrawal.

JURISDICTION

Likewise, CENTRO VITAL reserves the right to file civil or criminal actions it deems appropriate for the improper use of its website and contents or for the breach of these conditions.

The relationship between the user and the provider will be governed by current regulations and applicable in the Spanish territory. If any controversy arises, the parties may submit their conflicts to arbitration or go to the ordinary jurisdiction, complying with the rules on jurisdiction and competence in this regard. CENTRO VITAL is domiciled in BARCELONA, Spain.

SHIPPING AND DELIVERY

1. SHIPPING COSTS AND DELIVERY TIMES

* Shipments to the Canary Islands, Ceuta, Melilla, Andorra and Portugal will be made in 2/3 days (there may be delays derived from customs procedures).

The additional costs and taxes generated by customs procedures will be borne by the client.

2. PLACE OF DELIVERY

HOME DELIVERY

• The delivery of the order will be made until 8:00 p.m. (working days) at the address you have specified during the purchase process. If delivery cannot be made, we will contact you to agree on another delivery time section or another day, or if you prefer, they will indicate a nearby office where you can pick up the package.

3. DELIVERY DAYS

* On Saturdays, Sundays and holidays there are no deliveries.

RETURNS

1. CONDITIONS

For the exchange or return you must send an email and indicate if it is a change or a return and the reason. You have 30 calendar days to change or return your order. We only accept items that have not been used and that come in their original box and in perfect condition. Do not cut the labels until you are sure that you are going to keep the product.

WITH EXCHANGE OR RETURN OPTION INCLUDED

If all the conditions to be able to make an exchange or return are met, we will send you an email confirming that the process begins. We will try to collect the product a maximum of 2 times in the time slot you specify. If you are not at the specified address the second time, you should contact us and we will indicate a shipping office where you can take your package.

Once we receive the product in our warehouse and verify that it is in good condition, we will send you an email confirming the correct reception and we will proceed to:

• send you the new product in case of exchange, with the same shipping and delivery conditions.
• refund the money if it was a return, with the same method with which you made the payment and within a period of 7-14 days.

2. COSTS

If the type of shipment does not include the option to exchange or return, the costs of shipments generated during the exchange or return process will be borne by the customer. CENTRO VITAL includes an exchange or a return in your shipment. In the event that after making the first change, you finally do not want the product, you will have to bear the return costs according to your address.

In any case, the additional costs and taxes generated by customs procedures will be borne by the client.

3. REFUND OF PAYMENT

In case of unjustified delay on the part of CENTRO VITAL, regarding the return of the sums paid, the client may claim double the sums paid, without prejudice to the right to be compensated for the damages suffered in which it exceeds said amount.

4. DEFECTIVE PRODUCT

In the event that the product is not in good condition and the causes are not your consequence, you have the right to return the product, informing us of the reason for the return and at no cost to you. We undertake to bear the cost of the return and (if possible) to return the product for a new one in accordance with the conditions accepted at the time of sale.
